Official Rules for the NerdWallet Investing Roth IRA Writing Contest: Cash Prize Competition 2013.
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Promotion Description:
The Roth IRA Writing Contest (the “Contest”) ends on May 12th, 2013, at 9:00pm PDT. Sponsor’s computer is the official time-keeping device for the Contest. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of NerdWallet (“Sponsor”), which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Contest.
The Roth IRA Writing Contest (the “Contest”) is open only to legal residents of the United States and the District of Columbia, with the exception of Rhode Island, who are at least eighteen (18) years old at the time of entry. Employees of NerdWallet (“NerdWallet”) as well as their immediate family (spouse, parents, siblings and children) and household members are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. How to Enter
This contest is part of an ongoing investment education program run by NerdWallet Investing. Writing submissions should be emailed to firstname.lastname@example.org for consideration.
By entering the competition, you warrant that:
- You are eligible to enter this promotion;
- Your entry does not contain any virus, bug or technical defect that would corrupt or otherwise affect the security, integrity or operation of the competition entry page or any NerdWallet webpages or databases.
- You have permission from the original publisher or author to use any pictures you attach to your blog post entry or in your blog post entry.
It is the legal responsibility of the entrants, and not the promoters, to ensure they comply with copyright requirements where relevant and own the rights to use their blog for the purposes of this competition. NerdWallet reserves the right in sole discretion to reject any blog post entry that we deem to contain any objectionable or offensive content.
The entry submission deadline for participation is May 12, 2013 at 9:00pm PDT. We will inform the winning participants by email within two weeks of the submission deadline. The Contest proper begins on April 17, 2012 at 9:00am PDT and will end on May 12, 2013 at 9:00pm PDT (the “Contest Period”). Sponsor’s computer is the official time-keeping device for the Contest. Judging will then commence and the winner will be announced on or before May 26, 2013 at 9:00pm PDT.
Winner receives $500, second place receives $300, and third place receives $200. Sponsor’s decisions as to the administration and operation of the Contest, the selection of contestants and the awarding of prizing are final and binding in all matters related to the Contest.
Receiving a prize is contingent upon compliance with these Official Rules. All contestants will be required to sign and return a Declaration of Compliance, Liability and Publicity Release which must be received by an administrator, within seven (7) days of the date notice or attempted notice is sent, in order to participate. If a potential contestant cannot be contacted, or fails to sign and return the Declaration of Compliance, Liability and Publicity Release within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits the prize. In the event that a potential winner of the contest is disqualified for any reason, Sponsor will award the prize to the contestant with the next highest score.
Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Total ARV of all prizes: $1,000 USD.
The winners will be judged in combination by employees of the Sponsor, in particular by 4 judges from the Investing division of NerdWallet. They will judge from all valid entries received by the competition closing time.
The judges will select a sampling of the top entries and then collectively agree on the top three winners in order to determine the overall winner, followed by a second and third place winner. By entering the competition, the entrant warrants that the entrant’s entry and the entrant’s blog (whether in relation to the competition or not) doesn’t include material that is in any way unlawful, offensive or inappropriate. Entries that breach these regulations in the sole opinion of NerdWallet.com by being unsuitable, offensive, unlawful, misleading, derogatory of NerdWallet.com and/or any of its partners, in breach of any third party rights (including copyright), or the entrant/winner in any way acts inappropriately or dishonestly or in breach of any of these Terms and Conditions, NerdWallet reserves the right to either:
(a) reject or disqualify the entrant/winner(s):
(b) require the entrant/winner(s) to remove their blog posts from their own blogs: or
(c) withdraw the prize.
NerdWallet.com reserves the right to report any inappropriate content to the relevant authorities. All entrants including winners agree that their names, competition entries, blog addresses and/or blog entries may be published on http://www.nerdwallet.com, the NerdWallet Facebook page and/or the NerdWallet Twitter account at any time without notice.
NerdWallet.com holds no responsibility for entries lost or not received. NerdWallet.com will be acknowledging all entries to the competition so if the entrant doesn’t receive an acknowledgement of his or her entry, the entrant may want to resubmit the entry.
Acceptance of these terms and conditions is a condition of entry. Any personal data supplied to the Sponsor in connection with the competition will only be used for the purpose of this competition and as otherwise provided for in these Terms & Conditions.
By receipt of any prize, winners agree to release and hold harmless Sponsor and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
It is Entrant’s sole obligation to report all compensation received from Sponsor for services. Accordingly, Sponsor will issue Entrant an IRS Form 1099 for the prize.
Except where prohibited, participation in the Contest constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. An Entrant shall, and hereby does, assign and transfer to Sponsor all worldwide rights, title and interests in and to the content created for the contest, including without limitation, all rights in copyright, all rights in privacy, publicity, performance and celebrity in connection with the contest (including, without limitation, all rights to use Entrant’s name, image, biography, personal story, and likeness in connection with the content created for the contest), and the full, worldwide, perpetual and irrevocable right to exercise all such rights for any purpose, and in all media and by any manner and means now known or hereafter invented (collectively “Rights”). Entrant agrees that this assignment also includes all future derivatives, modifications or adaptations of the content created for the contest (collectively, “Derivatives”). Entrant has participated in the contest and created the Rights on special order for Sponsor, and the content and Rights are “work made for hire”.
12. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. Limits of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize. No more than the stated prize will be awarded.
Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state and Federal courts located in San Francisco, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
