My husband and I are getting a divorce and I need to move out of his parents home quickly. I don’t want to rent because its a vicious cycle and I’ll never own what my money is paying for. Also, if I buy a house before the divorce, does my husband have rights to it? Right now, we live in his parents house, don’t pay rent but we provide all the necessary care and maintenance since the parents are too old and can not afford repairs easily. My husband and I do not own ANYTHING together so I’m afraid he would try to get rights to my home.


In most jurisdictions, when you are in process of getting a divorce, ie you have filed or he has filed, you are usually prevented from making major financial moves such as buying a house without court approval. Hence to do it before the divorce has to be in the open.
If you have not filed, or he has not filed, you can buy a house in your own name. It would become part of the marital estate and subject to division.
However, in either case, if you are buying with zero down, it appears that there may not be equity to divide
