NerdWallet Cash Back Terms of Use

The NerdWallet Cash Back program allows you to get cash back on eligible purchases when you register one or more debit or credit cards with the NerdWallet Cash Back program, operated by our third party service provider Empyr, Inc. These NerdWallet Cash Back Terms of Use and Privacy Policy, together with NerdWallet’s Website Terms of Use and Privacy Policy, set forth the terms and conditions (“Cash Back Terms”) that apply to your use of and access to this service. To the extent there is a conflict between the NerdWallet Terms of Use or Privacy Policy and these Cash Back Terms, the provisions in these Cash Back Terms will govern your use of the Cash Back program.

By entering your payment card information, you agree to the following: you authorize your payment card network to monitor and share your transaction data made with your registered payment card at participating merchants with program and its third party service providers (including Empyr). The program shall obtain, provide, and/or use your transaction data to calculate your points, redeem rewards, enable card-linked offer(s), target offers that may be of interest to you, and to facilitate the program in accordance with the program’s Terms of Use and Privacy Policy. The program may share your transaction data with participating retailers to determine if you are eligible to receive the offered reward. You may opt-out of the program at any time in accordance with Section 8: How to Opt Out of the Program or Unlink a Card.

  1. Card Eligibility. The payment card network participating in the NerdWallet Cash Back program are Visa, MasterCard and American Express.  Not all Visa, MasterCard, and American Express cards are eligible for registration. The following cards are NOT eligible for registration:  corporate cards, company purchase or charge cards; prepaid cards, including government-administered prepaid cards or EBT cards; healthcare cards, including health savings account (HSA) cards, flexible spending accounts (FSA) or insurance prepaid cards; cards that are not processed through U.S. payment systems.

  2. Transaction Eligibility. There is a $250 cashback limit per transaction. Not all transactions with your registered Visa, MasterCard and American Express card are tracked by Visa, MasterCard and American Express.  You acknowledge that Visa, MasterCard and American Express may be unable to monitor every transaction made with your enrolled card, including debit or Personal Identification Number (“PIN”) based purchases, purchases you initiate through identification technology that substitutes for a PIN, payments made through other payment methods (such as a digital wallet or a third party payment app where you choose a Visa, MasterCard or American Express card as a funding source but you do not present your card directly to the merchant), payment of existing balances, balance transfers, or transactions that are not processed or submitted through the Visa U.S.A. MasterCard and American Express payment systems, and that these transactions are not eligible.

  3. Debit Instructions. If you register a debit card, your transaction must be processed as a “credit” transaction to make sure the transaction can be monitored.  Do not use the card as debit or use a PIN when paying for your purchases with your enrolled card if you want the transaction to be eligible for rewards or offer completion.

  4. Double Enrollment Restrictions. We use Empyr, Inc. as our service provider to operate our program.  Your credit card may only be enrolled in one program operated by Empyr.  If you have already enrolled a credit card with a separate program operated by Empyr, you will be unable to register that card in both the NerdWallet Cash Back program and the other Empyr-operated program.  You may enroll another payment card in NerdWallet Cash Back or deactivate your card in the other Empyr-operated program.

  5. Statement Credits. Statement credits will not appear or be reflected on your transaction receipt from the Merchant at the time of purchase, but instead will be reflected on your registered credit or debit card’s periodic card statement. Subject to the eligibility verification and settlement of the qualifying transaction, statement credits will appear once a user has accumulated $10 or more in cash back. Qualifying transactions may take up to three weeks to process and may be subject to delays.

  6. NerdWallet Membership Account Requirement.  Cash Back participants must have an active NerdWallet Membership Account in order to receive cash back credits.  If you cancel your NerdWallet Membership Account for any reason before your cash back credits have appeared on your registered card’s periodic card statement, you will forfeit any pending cash back credits.

  7. Limitation of Liability.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NERDWALLET AND ITS AFFILIATES, LICENSORS AND SUPPLIERS, INCLUDING PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS EXPRESSLY DISCLAIM ANY WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NERDWALLET AND ITS AFFILIATES, LICENSORS AND SUPPLIERS, INCLUDING PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS, DO NOT WARRANT THE DATA, CONTENT, ANALYTICS, FEATURES, OR INFORMATION PROVIDED THROUGH THE PROGRAM, INCLUDING WITHOUT LIMITATION TRANSACTION DATA OR USER SUBMISSIONS OR OTHER DATA PROVIDED BY OTHER USERS, TO BE UNINTERRUPTED, ACCURATE, USEFUL, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES WILL NERDWALLET OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS OR SUPPLIERS INCLUDING PAYMENT CARD NETWORKS OR PAYMENT PROCESSORS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OR RELATED TO THE PROGRAM, EVEN IF PROGRAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL NERDWALLET OR ITS AFFILIATES’, CONTRACTORS’, EMPLOYEES’, AGENTS’, OR THIRD PARTY PARTNERS’ OR SUPPLIERS’, INCLUDING PAYMENT CARD NETWORKS’ AND PAYMENT PROCESSORS’, TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PROGRAM (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED THE LESSER OF YOUR LIFETIME NERDWALLET CASH BACK EARNINGS OR $500.00.

8. How to Opt-Out of the Program or Unlink a Card. To opt out of the Cash Back Program and unlink your cards, you must follow the steps below:

  1. Go to “Settings” page

  2. Click on “Manage Accounts”

  3. Under “NerdWallet Cash Back” click on “Remove from NerdWallet Cash Back.”

  4. Confirm you want to unlink your card

  5. You must repeat this process for every card you wish to unlink.

NerdWallet Cash Back Privacy Policy

  1. Use of Cash Back Transaction Data. Notwithstanding anything to the contrary in the NerdWallet Terms of Use or Privacy Policy, NerdWallet and its third-party service providers, including Empyr, will use transaction data as follows:

    1. To confirm a qualifying purchase or return to match transaction to confirm whether you qualify for a statement credit or cash back;

    2. Share transaction data with the participating merchant where a transaction occurred as needed for the merchant to confirm a specific transaction occurred or points should be awarded; for example, the date and amount of your purchase and the last 4 digits of your card number so the merchant can verify your purchase with its records if there is a missing or disputed transaction;

    3. Provide participating merchants or third party service providers aggregated and anonymized information relating specifically to registered card activity solely to allow participating merchants and third-party service providers to assess the results of their campaign;

    4. Create a record of the transaction data and thereafter maintain and use data in connection with operating the Cash Back program;

    5. Conduct analysis for the improvement and optimization of the Cash Back program; and

    6. Provide information in order to respond to a request from a government authority or a payment organization involved in a transaction with you or a merchant.

You authorize the sharing, exchange, and use of transaction data described above and herein by and among NerdWallet and its third party service providers including Empyr, Inc., applicable payment card networks, including Visa, MasterCard and American Express, and applicable merchants.

If you have consented to participate in the NerdWallet Cash Back program, please visit the Terms Of Use to learn more about the rules and guidelines that apply to and govern your use of the program. If you would like to opt out of card linking and transaction monitoring in connection with the program, see opt-out instructions below.

3. How to Opt-Out of the Program or Unlink a Card. To opt out of the Cash Back Program and unlink your cards, you must follow the steps below:
